Hotsa’a LePoal” or “Execution of Judgment” – What is it?
Execution of Judgment (hotsaa lapoal), or “hotslap” for short, is an arm of the Enforcement and Collection Authority, and deals with debt collection and enforcement of court orders.
A person can be involved in an enforcement proceeding as a “debtor” (khayav), who must pay or perform an action, or as a “creditor” (zokhe or noshe), someone who is entitled to money or to the performance of an action by the debtor.
Cases handled by Execution of Judgment include: bad checks, unenforced judgments (e.g., monetary claims, child support, etc.), eviction of a tenant, and more.
Enforcement of execution of judgment may take steps such as seizing the debtor’s accounts, seizing a vehicle, prohibiting debtor from leaving the country, etc.
Opening a case with Execution of Judgment There are different tracks such as:
Regular track – the creditor or the case lawyer manages the case and submits applications, and the bureau acts in accordance with the requests.
Short track – The bureau acts to collect the debt – up to a debt of 25,000 NIS.
A file can be opened in the personal area of the Enforcement Authority website (except for the short track) or by arriving at the bureau (after making an appointment in advance).
Debtors can take advantage of legal assistance (siyua mishpati) from the state for a nominal fee, if they meet the criteria.
