Rights following a work accident or an occupational disease

What is considered a work accident?

  • Injury while working (at the workplace / during work) and as a result of work.
  • Injury on the way to or from work.
  • Injury by another person while working.
  • Injury during breaks (also not at the workplace, but in the commonly-agreed place for the break).
  • Injury during social activities on behalf of the employer.
  • Mental injury (in certain cases).
  • Injury while working from home if it occurred during and as a result of work.
    And more…

What is considered an occupational disease?
An illness caused by work, such as hearing problems due to noise, respiratory diseases due to exposure to chemicals, etc.

There are cases that will not be recognized as a work accident, such as injury due to negligence (under certain conditions).

What are the rights of someone who has been recognized as a work injury?
Free medical treatment in hospitals and health insurance funds (not at a private doctor), including hospitalization, tests, surgeries, medications, rehabilitation, equipment and anything else that may be required as a result of the injury.
The health insurance fund must also finance evacuation by ambulance, if any.

Injury benefits (dmei pgia) – compensation for loss of wages provided that the person is unable to work as a result of the injury. Payment period – during the period of not working up to a maximum of 91 days from the day after the injury, at a rate of approximately 75% of the wage (up to a certain maximum).
If needed:

  • Disability benefit from work (gimlat nahut me-avoda) – if the incapacity lasts beyond 90 days. Provided as a one-time grant or as a monthly allowance (depending on the percentage of disability that will be determined).
  • Vocational rehabilitation – training for a new profession if it is not possible to return to the previous job.
  • Family members’ rights – in the event of the employee’s death.
